Any person making use of the information, documents, products, software and various services (collectively "Services") offered by this site is deemed to have read and accepted all of these terms and conditions of use.

The website lmih.lu and its contents are published by the Ministry of Foreign and European Affairs ("MFEA"), which is located at 9, rue du Palais de Justice L-1841 Luxembourg, Luxembourg.

The publication is managed by Beryl Koltz, Strategic Manager at the MFEA.

The website was designed and developed by the communication agency Binsfeld, 14, Place du Parc, L-2313 Luxembourg.

For the submission of requests, users are invited to submit forms via the Optimy platform. Optimy S.A., Brussels, hosted by Amazon Web Services, 38 avenue John F. Kennedy, Luxembourg, manages this platform and the cloud management is outsourced to Skyscrapers (Komiteitstraat 48, B2170 Merksem, Belgium).

 

1. OBLIGATIONS OF THE USER

Access to the site is via the Internet. The user declares that they is aware of the risks and accepts them. They must protect themselves against the effects of computer piracy by adopting an appropriate and secure computer configuration.

The MFEA shall not be held liable for any damage that the user may suffer directly or indirectly in connection with browsing this site and using its services as well as the Internet sites to which it refers.

The use of the site is free.

 

2. INTELLECTUAL PROPERTY

The site, all its elements (including the layout) as well as the information and projects entered by the user as part of the forms submitted via the Optimy platform, are protected by intellectual property laws, in particular the amended law of 18 April 2001 on copyright, related rights and databases and the Benelux Convention on intellectual property. Unless otherwise stated, the MFEA does not grant any license or authorization with respect to the intellectual property rights it has in this site, its elements or the services.

Any project or idea submitted through the platform will remain the sole and exclusive property of the submitter. No property rights will be transferred to the platform or to a third party. 

 

3. USE OF CONTENT

  • TEXT DOCUMENTS : unless otherwise specified, the user is authorised to consult, download and print text documents without prior request, in the context of promoting Luxembourg and for non-commercial purposes.
  • LOGOS : the graphic elements are available for download for the purpose of developing a concept that must then be validated by the brand image promotion service at the MFEA.
  • OTHER CONTENTS : unless otherwise indicated, the reproduction of other types of content (photos, videos, sound files, animations, graphics, etc.) is authorised in the context of promoting Luxembourg, for non-commercial purposes, provided that the source is mentioned.

These types of content may not be sold or rented for a fee under any circumstances.

Any modification, transformation or adaptation, total or partial, of the aforementioned types of content is prohibited.

Users who reproduce content from the portal undertake not to use it in a manner contrary to human dignity and respect for the person.

Unless expressly permitted by the publisher, the lmih.lu portal may not be integrated in any way, in whole or in part, into any other portal or website without express permission of the publisher.

The rights implicitly or explicitly granted to you above constitute an authorisation of use and in no way a transfer of rights, property or other relating to this portal.

The MFEA will do its best to ensure maximum availability of this site. However, it cannot be held responsible for the temporary or total unavailability of the site.

The MFEA will ensure the security of the computer system as far as possible. However, it cannot be held responsible in the event of an attack on the computer system or the temporary or total unavailability of the site.

The MFEA reserves the right to refuse the user access to the website at any time and without prior notice.

 

5. MODIFICATION OF THE SITE

The MFEA reserves the right to change, modify or suspend, without prior notice, this site for maintenance, updating or any other reason deemed necessary.

The MFEA may at any time withdraw, add to, complete or specify all or part of the information and services contained or offered on the site. The MFEA shall not be liable for any direct or indirect damage in connection with such changes.

The present terms and conditions of use can be modified or completed at any time, without prior notice, according to the modifications made to the site, the evolution of the legislation or for any other reason considered necessary. It is the user's responsibility to inform themselves of the terms and conditions of use of the site, of which only the updated version accessible online is deemed to be in force. It is possible that between two uses of the site, the particular terms and conditions of use are modified and it is therefore the responsibility of the user to read them properly before each new use.

4. COLLECTION OF DATA FROM THE DATA SUBJECT : MANDATORY NATURE OF THE DATA PROVISION AND THE CONSEQUENCES OF REFUSING TO PROVIDE IT

The provision of your Data to the MFEA is mandatory for the processing of requests and forms. Your refusal to provide us with the requested Data would make it impossible to process your requests and provide a response.

 

5. RETENTION PERIOD

Your Data is kept in a form that allows you to be identified for a period of 5 years from the date of your event or project or the processing of your request, as appropriate.

The above retention periods apply without prejudice to possible further processing for compatible purposes, in particular for statistical or scientific research purposes or for archival purposes in the public interest (in particular their retention by the National Archives) or for the purposes of ongoing legal proceedings.

 

6. THE TRANSFER OF YOUR DATA TO A THIRD COUNTRY

Your data will in principle be processed within the European Economic Area. The MFEA may, however, transfer your data to a third country (i.e. one that is not part of the European Economic Area). Data transfers are carried out in accordance with the conditions set out in Chapter V of Regulation (EU) 2016/679. More information about possible international transfers of your data can be obtained from our Data Protection Officer.

 

7. THE RIGHTS OF THE DATA SUBJECT

You have the rights provided by the provisions of Chapter III (Articles 12 to 22) of Regulation (EU) 2016/679. You may thus, within the limits of the applicable legislation, access and obtain a copy of the data concerning you (Article 15), obtain the rectification of inaccurate or incomplete data (Article 16) and obtain the deletion of such data under the conditions provided for in Article 17 of the said Regulation.

You also have, within the limits of the applicable legislation, the right to object to the processing of your data under the conditions set out in Article 21 of Regulation (EU) 2016/679.

In certain cases, you also have the right to limit the processing of your data (Article 18) and to portability (Article 20).

The processing of your data does not involve any automated decision making that produces legal effects on you or significantly affects you in a similar way.

Any communication relating to a request for information, concerning a complaint or regarding the exercise of your rights under the provisions of Regulation (EU) 2016/679 should be addressed to the MFEA's Data Protection Officer.

 

8. COMPLAINT TO THE NATIONAL COMMISSION FOR DATA PROTECTION (CNPD)
